Workplace Affairs and Company Discipline

If your spouse's affair partner is a coworker at the same company, the issue of company discipline comes along separately from the affair lawsuit. Whether you are the one wanting to tell the company or the one facing discipline, you need to know where private life ends and workplace order begins before you act.

You may need a consultation if

  • Your husband and the other woman still work in the same department
  • You want to tell the company so the affair partner is moved to another department
  • The other person's spouse came to the company and an HR investigation has begun
  • You were notified of a suspension because of a workplace affair
  • You are a public official and have been referred to a disciplinary committee for violating the duty to maintain dignity

Relevant provisions

Labor Standards Act (근로기준법) Articles 23(1) and 28 (Restrictions on dismissal; application for remedy)

An employer may not dismiss, place on leave, suspend, transfer, reduce the pay of, or otherwise discipline an employee without just cause. If you consider it unfair, you can apply to the Labor Relations Commission for a remedy within 3 months of the date of the action.

State Public Officials Act (국가공무원법) Articles 63 and 78 (Duty to maintain dignity; grounds for discipline)

Public officials must not engage in conduct that damages their dignity, whether on or off duty, and conduct that damages their honor or prestige is a ground for discipline.

Statutes are summarized. The official Korean text is available at the Korea Law Information Center (law.go.kr).

Private life alone rarely justifies discipline

The Supreme Court holds that an employee's misconduct in private life is a legitimate ground for discipline only if it is directly related to business activities or risks harming the company's public reputation (Supreme Court Decision 93누23275, rendered December 13, 1994). An affair itself is a private matter, so a dismissal based on that alone leaves ample room to challenge it.

However, the judgment can change if the two kept meeting during working hours or business trips and work was disrupted, if they used company facilities, or if gossip in the office disturbed workplace order. If a superior used their position in the relationship, it can also become a matter of workplace sexual harassment or bullying.

Public officials and public institutions face stricter standards

Public officials can be disciplined for violating the duty to maintain dignity even for conduct outside their duties. Public institutions and some companies also have dignity clauses in their rules of employment, so the risk of discipline is greater than at ordinary companies.

In disciplinary proceedings, you are given an opportunity to explain. It's advisable to set out in writing how the relationship came about, that it did not affect your work, and that you have already ended it.

If you are the spouse wanting to tell the company

Telling the company may seem like a way to separate the two, but depending on how widely and in what way you tell, you could face a criminal complaint for defamation (명예훼손) or obstruction of business (업무방해). Posting in a group chat or on a bulletin board seen by many employees is especially risky.

If separating them at work is truly necessary, adding clauses such as no contact outside work or efforts toward a department transfer to an affair-lawsuit mediation or settlement agreement carries less legal risk.

Frequently asked questions

The company says it will fire both me and the other woman.

A dismissal based solely on the affair can be challenged as lacking just cause. We examine whether the grounds and procedure for dismissal comply with the rules of employment and whether work was actually affected. At workplaces that regularly employ 4 or fewer workers, the dismissal restrictions may not apply, so check the size of the company too.

Is there a way to separate the two without telling the company?

You can put clauses such as no contact outside work, no meeting alone and a penalty for breach (위약벌) into an affair-lawsuit mediation or settlement agreement. If they are in the same department and contact cannot be avoided, the parties sometimes negotiate a promise that the affair partner will request a transfer or resign.

The company says it will close the matter without discipline if I submit a resignation letter.

If you resign, it is not a dismissal, so it becomes hard to challenge it later as an unfair dismissal. If the grounds for discipline are weak, don't rush; weigh the terms of leaving and the disadvantages before deciding.
