Certified Letters & Settlement Agreements

If you want to resolve the matter without a lawsuit, a certified letter and a settlement agreement are the tools for it. Once signed, a settlement agreement is hard to change, so look at the wording before the amount.

You may need a consultation if

  • A lawsuit feels like too much, and you want to give a warning by certified letter first
  • The affair partner contacted you first, proposing a settlement
  • The other side wants you to sign a draft settlement agreement they sent
  • The two are seeing each other again even after the settlement
  • The settlement money has not arrived by the agreed date
  • You would rather settle quietly than have a written judgment on record

Relevant provisions

Civil Act (민법) Article 398 (Predetermined damages)

An agreed breach payment (위약금) is presumed to be liquidated damages (손해배상액의 예정) (paragraph 4), and if the predetermined amount is unreasonably excessive, the court may reduce it appropriately (paragraph 2).

Civil Mediation Act (민사조정법) Article 29; Family Litigation Act (가사소송법) Article 59(2)

A mediation reached in court has the same effect as a judicial settlement, so compulsory execution can be carried out on the basis of the mediation record (조정조서).

Civil Execution Act (민사집행법) Article 56, item 4

A notarial deed (공정증서) drawn up by a notary for payment of a fixed sum of money, stating that the debtor consents to compulsory execution, serves as a basis for compulsory execution even without a judgment.

Criminal Act (형법) Article 307(1) (Defamation)

A person who damages another's reputation by publicly alleging facts faces up to 2 years' imprisonment with or without labor, or a fine of up to KRW 5 million. This is why you should avoid sending a certified letter to someone's workplace or family.

Statutes are summarized. The official Korean text is available at the Korea Law Information Center (law.go.kr).

Clauses to include in a settlement agreement

  • Payment of compensation

    What to set
Amount, due date, bank account, whether in installments, what happens if payment is late
    Problem if omitted
Hard to collect promptly even after the deadline passes
  • Period covered

    What to set
Up to what date the infidelity is being settled
    Problem if omitted
Disputes over whether conduct after the settlement is also released
  • No further contact

    What to set
Scope of the ban, such as calls, texts, social media and contact through others, and work-related exceptions
    Problem if omitted
Renewed disputes over what counts as a breach
  • Payment on breach

    What to set
Amount per breach and its nature (penalty for breach or liquidated damages)
    Problem if omitted
Arguments for reduction or disputes over validity

A settlement agreement signed only between the parties cannot be enforced directly, so if it has installment or breach-payment clauses, we also consider recording it in a notarial deed or a court mediation record.

A certified letter is both a warning and a record

A certified letter (내용증명) is mail for which the post office certifies what document was sent, when and to whom. It does not by itself oblige the other person to reply or pay, but it formally puts on record that you know about the infidelity (부정행위) and intend to pursue legal liability. It is not unusual for the other person, now taking the prospect of a lawsuit seriously, to get in touch about a settlement.

The certified letter states that a marriage exists, the infidelity you have confirmed, your demands and a deadline for a reply. You don't need to reveal all your evidence. If you describe the types of evidence in detail, the other side can prepare its counterarguments in advance.

What to avoid before sending

Avoid sending a certified letter to the person's workplace or parents' home, or including wording such as "If you don't comply, I will tell your company." Even if what you write is true, defamation (명예훼손) can become an issue once several people learn of it, and threatening to tell while demanding money can escalate into accusations of threats (협박) or extortion (공갈).

Insults or exaggerated wording will also be submitted by the other side as evidence in a lawsuit. Some affair partners who receive a certified letter say they will end the relationship and then delete their chats, so secure the evidence you need before sending.

The wording decides what a settlement agreement means

If the agreement simply says no objections of any kind will be raised in future, a court may read it as a promise covering conduct up to the date the agreement was signed. That means meeting again after the settlement can be pursued separately as new infidelity. So write down the date up to which conduct is being settled, and make clear how conduct after that date will be handled.

A no-contact clause must specify the methods of contact that are prohibited. If the two work at the same place and cannot avoid seeing each other for work, set that exception in advance as well. If the scope is vague, you will end up arguing again over whether something is a breach.

A breach payment and a penalty for breach are treated differently

In a clause stating that a certain sum will be paid if the promise is broken, if that sum is simply called a breach payment (위약금), the law presumes it to be liquidated damages (손해배상액의 예정). The court can reduce liquidated damages if they are unreasonably excessive. To make it a sanction for the breach itself, the wording must make clear that it is a penalty for breach (위약벌).

It is realistic to set the amount within what the other person can actually afford. An excessively large amount makes a settlement itself harder and can also give grounds to dispute its validity later.

Prepare for the agreement not being kept

A settlement agreement signed only between the parties cannot be enforced directly, so if the money doesn't arrive, you have to go through a lawsuit or a payment order again. If there are installment or breach-payment clauses, consider making it a notarial deed (공정증서) with consent to compulsory execution or, if a lawsuit is pending, recording it in a court mediation record (조정조서).

Compared with a judgment, a settlement takes less time and can include terms that a judgment cannot set, such as no further contact, confidentiality and a waiver of reimbursement (구상권). On the other hand, not having a written judgment on record can be a drawback, so decide first what matters more to you and then choose the direction.

How Jisan Law's Family Law Center handles your case

  1. 1

    Deciding the result you want

A managing partner first asks which matters most to you, the amount, ending the relationship or confidentiality, and sets the direction.

  2. 2

    Sending after securing evidence

After securing the evidence needed, we draft a certified letter in the lawyer's name and send it to the other person directly. We do not use methods that inform their workplace or family.

  3. 3

    Negotiation

Jisan Law, as your representative, negotiates the terms with the other person or their representative. You do not need to meet the affair partner yourself.

  4. 4

    Drafting the settlement agreement

We draft the payment, no-contact, breach payment, confidentiality, reimbursement and further-claims clauses, reviewing the wording line by line.

  5. 5

    Securing performance

If there are installment or breach clauses, we consider a notarial deed or mediation record; if payment is late, we move on to enforcement procedures.

Frequently asked questions

I sent a certified letter, but there's been no reply.

A certified letter cannot force a reply. If there is still no answer after the reply deadline, we decide whether to move on to a lawsuit or a provisional attachment (가압류). The certified letter you sent can be submitted in the lawsuit as evidence of when you made what demands.

I don't know the affair partner's address, so I can't send a certified letter.

If the address is unknown, a lawyer can contact the person by phone and deliver a written notice with the same content. If no agreement is reached, after filing a lawsuit, their identity and address are confirmed through court procedures. Since this takes time, we also check the time limit for your claim.

The two met again after the settlement. Can I claim again?

Meeting after the settlement can be treated as new infidelity, so you can claim compensation separately, and if there is a payment-on-breach clause, you can claim that amount too. However, if the marriage is found to have already broken down in the meantime, liability may not be recognized, so you need evidence showing the state of the marriage.

Can I also get a written apology from the affair partner?

A written apology is sometimes made a condition of settlement. A judgment cannot compel an apology, so this is a term that can only be set by agreement. How the apology is kept and who it may be shown to should be decided together with the confidentiality clause.

What changes if the settlement agreement is notarized?

A notarial deed that contains a promise to pay money and states that the debtor consents to compulsory execution serves as a basis for compulsory execution even without a judgment. That is why it is often used for settlements that take time to perform, such as installment payments. Note that non-monetary promises, such as no further contact, cannot be enforced directly this way.
