Judicial Divorce and Emotional Distress Compensation

If your spouse will not agree to a divorce or you cannot agree on the terms, the court decides. The grounds for divorce and the claim for compensation require proof of different things, so prepare the evidence separately for each claim from the start.

When you should get advice

  • My spouse insists they will never agree to a divorce
  • I found out about an affair, but I don't know what evidence I need
  • Verbal abuse and violence continued, so I left home with my child
  • We've been separated for years, and now I want to settle things legally
  • I can no longer bear the insults and interference from my in-laws
  • I received a notice of a divorce mediation session from the court

Relevant provisions

Civil Act (민법) Article 840 (Grounds for judicial divorce)

A divorce may be claimed if the spouse committed an unchaste act, maliciously deserted the other, the spouse or the spouse's lineal ascendants treated one extremely unfairly, the spouse treated one's own lineal ascendant extremely unfairly, the spouse has been missing for 3 years or more, or there is any other serious reason making it difficult to continue the marriage.

Civil Act Articles 841 and 842 (Extinction of the right to claim divorce)

A divorce cannot be claimed on the ground of infidelity if there was prior consent or later forgiveness, or once 6 months have passed since learning of it or 2 years since it occurred; on the ground in Item 6, it cannot be claimed once 6 months have passed since learning of it or 2 years since it occurred.

Civil Act Articles 843 and 806 (Damages)

Damages arising from a judicial divorce follow the rules on damages for breaking off an engagement, so a claim can be made against the spouse at fault for property damage as well as for emotional distress.

Family Litigation Act (가사소송법) Article 50 (Mandatory mediation)

For a judicial divorce, mediation must be requested first, and if a lawsuit is filed without mediation, the family court refers it to mediation. Exceptions apply when the other party can only be summoned by public notice or when mediation is deemed impossible.

Statutes are summarized. The official Korean text is available at the Korea Law Information Center (law.go.kr).

Based on current provisions on the Korea Law Information Center, the government's official legislation database (checked October 2026). There is no legal standard for the amount of compensation; the court decides it case by case.

A divorce lawsuit starts with mediation

Divorce is a case that must go through mediation (조정) before a lawsuit. At the mediation session, the mediators and the judge hear both sides and work out, all at once, whether to divorce along with property division (재산분할), compensation for emotional distress (위자료), parental authority and custody, and child support. If mediation succeeds, it has the same effect as a judicial settlement and the divorce becomes final.

If no agreement is reached, the court may on its own issue a decision in lieu of mediation (조정을 갈음하는 결정). If you disagree with this decision, you must file an objection within 2 weeks of being served with the original copy, and if there is no objection, it becomes final as is. If mediation ultimately fails, the matter is decided by judgment after hearings.

Each ground for divorce is proved differently

A judicial divorce (재판상 이혼) is possible even without the other spouse's consent if a ground set by law is recognized. However, the plaintiff must prove that ground, so the material to collect depends on which ground you claim. Infidelity can qualify even without sexual intercourse if the act breaks the spouses' duty of fidelity.

  • Infidelity: messages and photos, lodging and card payment records, conversations in which the other person admitted the facts
  • Malicious desertion: account records showing living expenses were cut off, and when and how the spouse left home
  • Extremely unfair treatment: medical certificates and medical records, records of 112 (police) reports, recordings of verbal abuse
  • Other serious reasons making it difficult to continue the marriage: the length and circumstances of the separation, records showing communication stopped, records of couples counseling

Evidence must be gathered lawfully

Recording a conversation you take part in is not a problem, but secretly recording a conversation between other people that you are not part of can violate the Protection of Communications Secrets Act. Unlocking your spouse's phone to read messages, secretly logging into their accounts, or putting a GPS tracker on their car can also turn into criminal matters.

Material obtained this way can instead give the other side grounds to strike back. For financial transaction records or call records that are hard to obtain on your own, we first consider getting them after the lawsuit begins through the court's fact inquiries and document production orders.

Compensation is set by the degree of responsibility

Compensation for emotional distress is money claimed from the person responsible for the breakdown of the marriage to make up for the emotional suffering caused. The court sets the amount by considering how the breakdown came about, the degree of responsibility, the length of the marriage, both spouses' ages and occupations, and their financial situation. There is no table of standard amounts set by law.

Compensation is a different kind of claim from property division, so both can be claimed together. Claims can also be brought against third parties, such as your spouse's affair partner or in-laws directly responsible for the breakdown, and these are sometimes handled together with the divorce case.

You can also ask the court to set arrangements during the lawsuit

A divorce lawsuit can take more than a year, but questions like who will care for the child and how to cover living expenses cannot wait. When you file the lawsuit or request mediation, you can also apply for pre-trial measures (사전처분) such as designating a temporary custodial parent, payment of child support, visitation, and a ban on disposing of assets.

If there is a risk that the other spouse will dispose of assets, we first consider provisional attachment (가압류) or a provisional injunction (가처분) before or when filing. In cases involving children, a family investigator (가사조사관) often interviews both sides and visits the home to look at the child-rearing environment, so we prepare for that as well.

How Jisan Law's Family Law Center handles a divorce lawsuit

  1. 1

Building a timeline of the marriage

The managing partner hears your story personally and arranges, in date order, when conflicts arose and what happened after the marriage. From this timeline, we pick out the grounds for divorce and the grounds for compensation.

  2. 2

    Sorting the evidence

We sort the material you have by whether it will be used for the grounds for divorce, compensation, property division or custody, and check whether anything missing can be obtained through the court.

  3. 3

    Preservation measures and pre-trial measures

If you are worried about assets being disposed of, we apply first for provisional attachment or a provisional injunction, and if matters concerning the child or living expenses are urgent, we apply first for a pre-trial measure.

  4. 4

    Mediation and hearings

Before the mediation session, we decide which terms you can accept and which you cannot give up. If mediation fails, we proceed with the hearings using briefs and evidence.

  5. 5

Wrapping up after the decision is final

Once the judgment or mediation becomes final, we check that the divorce is reported within 1 month and that compensation payments and registration transfers actually take place, and apply for compulsory execution if needed.

Frequently asked questions

Will it hurt my case if I leave home with my child before the lawsuit?

A separation with a reason, such as escaping violence or living apart by agreement, is not a disadvantage in itself. However, if you leave home without any explanation and also cut off living expenses, the other spouse may claim it was malicious desertion. Keep a record, such as messages, of the date you left and the reason.

My spouse has cut off contact and I don't know where they live. Can I still sue?

If the address is unknown, the court can proceed by service by public notice (공시송달), and in that case the trial may go ahead directly without mediation. Being out of contact is a different ground from it being unknown for 3 years or more whether the spouse is alive, so we organize how contact was lost and the circumstances before and after, and decide which ground to claim.

Can I also claim compensation from my spouse's affair partner?

You can also claim compensation from a person who engaged in infidelity knowing your spouse was married. It can be handled together with the divorce case or brought as a separate lawsuit. The claim cannot be made once 3 years have passed since you learned of the damage and the person responsible, so check the deadline first.

Do I have to attend the mediation session in person?

In family litigation, the parties are in principle required to attend in person. If there are special circumstances, only your lawyer may attend with the permission of the presiding judge or the head of the mediation committee (Family Litigation Act Article 7). However, in mediation the parties often need to decide the terms themselves, so whether to attend is decided to suit the case.

Can I claim compensation and property division at the same time?

Yes. Compensation is damages for responsibility for the breakdown, while property division settles the assets built together, so the legal basis and the standards for judging them are different. That is why even a spouse responsible for the breakdown can claim property division, and conversely, even for the spouse not at fault, the division ratio is set by contribution.
