Claims Against the Affair Partner

To receive compensation from your spouse's affair partner, you must show not only that the affair happened, but also that the affair partner knew your spouse had a family. Before filing the complaint, we first work out what material will prove these two points.

You may need a consultation if

  • You have confirmed your spouse's affair and know who the other person is
  • You don't want a divorce but want to hold the affair partner responsible
  • You expect the other person to claim they didn't know your spouse was married
  • The two are still seeing each other even after the affair came out
  • The affair partner is actually sending you mocking messages
  • You worry whether you will actually get paid even if you win a judgment

Relevant provisions

Civil Act (민법) Article 750 (Tort)

A person who causes damage to another through an unlawful act, intentionally or negligently, is liable to compensate for that damage. This is the basic legal ground for a compensation claim against an affair partner.

Civil Act Article 751(1) (Compensation for non-property damage)

A person who injures another's body, liberty or reputation, or otherwise causes mental suffering, must also compensate for non-property damage, that is, compensation for emotional distress (위자료).

Civil Act Article 760(1) (Liability of joint tortfeasors)

When several people cause damage to another through a joint unlawful act, they are jointly and severally liable. The unfaithful spouse and the affair partner share liability together.

Civil Act Article 766 (Extinctive prescription of damage claims)

The claim lapses 3 years after the day the victim learned of the damage and the wrongdoer, or 10 years after the day of the unlawful act.

Statutes are summarized. The official Korean text is available at the Korea Law Information Center (law.go.kr).

  • Ongoing marriage

    What the claimant must show
That the couple's shared married life was actually continuing at the time of the infidelity
    Typical evidence

If the affair partner argues that the marriage had already broken down beyond repair at the time of the infidelity, the affair partner must prove it (Supreme Court Decision 2022므13504, 13511, rendered June 27, 2024).

The affair alone does not win compensation

Legally, a compensation claim against an affair partner (상간자) is a claim for damages based on tort. The case name on the complaint (소장) is usually simply "damages." Even if your spouse's affair is clear, the court separately examines whether the affair partner acted intentionally and whether the marital relationship was actually continuing at the time.

So preparing the lawsuit begins with choosing evidence that matches the requirements the court will check. Even with several photos of the two entering a motel, the claim can be dismissed if there is no evidence that the affair partner knew of the marriage. Conversely, even without evidence of sex, infidelity (부정행위) is recognized if there are enough signs of an ongoing romantic relationship.

You must show the affair partner knew

Case law does not go so far as to require people to check whether every partner they date has a spouse. So it is up to the claimant to show, with evidence, that the affair partner knew or could have known about the marriage.

The most common evidence is the conversations between the two. Mentions of your spouse's husband, wife or children, pressure to get a divorce, or remarks that contact is difficult because of a family trip all suggest knowledge of the marriage. If there are no such conversations, we gather indirect evidence, such as a messenger profile showing a family photo or a coworker's statement that the marriage was known at the workplace, and organize it by period.

The amount is decided case by case

There is no fixed schedule for compensation for emotional distress (위자료). The court looks at the length of the marriage and whether there are children, the duration and extent of the infidelity, how clearly the affair partner knew of the marriage, their attitude after being found out, and the effect on the marriage. If you have already received compensation from your spouse, that amount may also be considered when assessing the total harm.

The amount claimed is set by attaching grounds to these circumstances. Records of the two continuing to meet after being found out, and messages mocking the plaintiff or demanding that the family be broken up, are grouped separately and submitted as aggravating circumstances for the amount.

  • Length of the marriage and childcare situation
  • Duration, frequency and extent of the infidelity
  • When and how clearly the affair partner knew of the marriage
  • Whether they ended the relationship or apologized after being found out
  • Changes in the marriage, such as separation or divorce

First check the time limit and the other party's identity

A compensation claim lapses 3 years after the day you learned of the damage and the wrongdoer. Here, "learned" means not when you vaguely suspected, but when you concretely knew who the affair partner was and what kind of relationship it was. If time has passed while you were weighing a divorce, we first need to determine the starting date.

To file a complaint, you need the other party's name and address. Even if you only know a phone number, car plate number or bank account number, after filing the lawsuit their identity can be confirmed through the court's fact inquiry (사실조회) or a document production order (문서제출명령). These procedures also take time, so if little time remains, you need to move quickly.

We plan all the way to actually getting paid

Even after a judgment, if the affair partner does not pay, you must seek compulsory execution against their bank deposits, salary or real estate. As a rule, one-half of a salary cannot be seized (Civil Execution Act (민사집행법) Article 246), so you may not be able to collect everything at once.

If there is a risk the affair partner will dispose of assets, we consider a provisional attachment (가압류) before the lawsuit. Not every application for a provisional attachment is granted: you must show the need for preservation and are usually required to provide security, so we decide after first looking into the other party's financial situation.

How Jisan Law's Family Law Center handles your case

  1. 1

    Hearing your situation

A managing partner personally hears how you found out about the affair and where your marriage stands now, and first checks whether the time limit for a claim is still open.

  2. 2

    Organizing evidence by requirement

We sort the material you have into infidelity, knowledge of the marriage and the ongoing marriage, and mark where gaps remain.

  3. 3

    Setting the amount claimed

We weigh the length of the marriage, the duration and extent of the infidelity, and the attitude after it came out, to set an amount with a clear basis. If there is a risk of assets being disposed of, we also consider a provisional attachment.

  4. 4

    Filing the complaint and hearings

We file the complaint with the evidence organized in date order. If the other party argues they didn't know or that the marriage had already broken down, we submit a rebuttal brief and further evidence.

  5. 5

    Mediation or judgment, and enforcement

In mediation, we decide with you whether to include a no-contact clause and a payment clause for breach. If no payment is made after judgment, we apply for compulsory execution.

Frequently asked questions

Can I sue without evidence of sex?

Yes. Case law views infidelity more broadly than adultery, covering any unfaithful conduct that breaches the spouses' duty of fidelity. Conversations of the kind exchanged between lovers, repeated one-on-one meetings and overnight stays, and travel records can together be recognized as infidelity. However, if the relationship was less intense, the amount may be set lower.

I don't know the affair partner's name, only their phone number.

You can start a lawsuit with just a phone number. After filing the complaint, the court can send a fact inquiry to the mobile carrier or issue a document production order to confirm the person's name and resident registration number; their address is then confirmed and the complaint is served. Confirmation takes time, so we check the time limit at the same time.

Will I get more compensation if I have psychiatric treatment records?

Treatment records are used to show that the emotional suffering was serious. However, the amount is not calculated so that it rises with the number of visits; it is judged together with the other circumstances. Before submitting the records, we first check that they do not contain sensitive information unrelated to the case.

We are in a de facto marriage. Can I claim against the affair partner?

A de facto spouse (사실혼 배우자) can also claim compensation from the affair partner. However, because the marriage was not registered, you need to show more carefully that you actually lived together as a married couple and that the affair partner knew this. Your shared address, visits between both families, and signs that you introduced each other as spouses can serve as evidence.

What happens if the two keep seeing each other during the lawsuit?

The fact that the relationship continued during the lawsuit can be seen as a lack of remorse and reflected in the amount. For newly confirmed meetings, write down the dates and places, gather the evidence, and submit it additionally. Even then, it is safer to respond through your legal representative than to confront them in person.
