When you should get advice
- I wanted it over quickly, so we divorced by agreement without discussing assets
- After the divorce, I found out there was an apartment in my ex's name
- We got a divorce judgment, but severance pay and shares were left out
- We wrote 'property matters are settled' in the agreement, but hidden assets have come to light
- My ex put the home up for sale after the divorce
Relevant provisions
Civil Act (민법) Article 839-2 (Right to claim property division)
A person divorced by agreement may claim property division from the other spouse, and if they cannot agree, the family court decides, taking into account the amount of assets built through both parties' cooperation and other circumstances. The right to claim property division expires 2 years after the date of divorce.
Civil Act Article 843 (Provisions applied mutatis mutandis)
The provisions on the right to claim property division and the right to revoke fraudulent acts to preserve it also apply to judicial divorce.
Civil Act Article 839-3 (Right to revoke fraudulent acts to preserve the right to claim property division)
If a spouse disposed of assets knowing it would harm the exercise of the right to claim property division, you can ask the family court to revoke the disposal and restore the assets.
Statutes are summarized. The official Korean text is available at the Korea Law Information Center (law.go.kr).
The 2 years cannot be extended
The 2 years is not a statute of limitations but an exclusion period (제척기간), so it is not paused or extended just because you made a demand to the other spouse. It is met only if a mediation application or petition for a ruling is filed with the family court within the period.
The reference 'date of divorce' is the day the divorce was reported for a divorce by agreement, or the day the judgment became final for a judicial divorce. Check the date on your detailed marriage relationship certificate (혼인관계증명서 상세), and if the deadline is near, it is safer to file first even if you have not gathered all the material.
Assets left out of the claim are hard to claim again
In a decision of June 22, 2018 (2018스18), the Supreme Court held that if only some assets were claimed within the 2 years, the right to claim the remaining assets disappears once the period passes. If assets that were not dealt with at all in the proceedings are newly discovered after the decision becomes final, an additional claim is possible, but that additional claim must also be made within 2 years of the date of divorce.
So when you first file the property division (재산분할) claim, list every asset you know of, and it is a good idea to state that you will expand the claim for assets still being checked depending on the results of the asset inquiry.
If the agreement contains a waiver clause
A clause such as 'neither party will make any claim regarding property in the future' does not block a claim in every case. Its effect may be judged differently depending on whether it was a pledge written before the divorce took effect that simply waived the right in advance, or an agreement that settled accounts after reviewing all the assets.
Organizing the date it was written, the list of assets you knew of at the time, and how you came to sign it can be used to challenge its validity.
Keep the assets from disappearing while you wait
If the other spouse is trying to sell the home or is moving deposits, apply for provisional attachment (가압류) or an injunction against disposal (처분금지가처분) together with the claim (Family Litigation Act Article 63). If you do not know exactly what the other spouse owns, you can apply for an asset disclosure order (재산명시) and asset inquiry (재산조회) to obtain records from financial institutions and public agencies (Articles 48-2 and 48-3 of the same Act).
If the assets have already been transferred to someone else's name, we also consider a lawsuit to revoke that disposal. This lawsuit must be filed within 1 year of learning the grounds for revocation and within 5 years of the disposal (Civil Act Articles 839-3(2) and 406(2)).
How Jisan Law's Family Law Center proceeds
- 1
Calculating the deadline
The managing partner consults with you personally, checks the date of divorce and the deadline, and sets the filing schedule according to the time remaining.
- 2
Listing the assets
We write down every asset you know of, including real estate, deposits, shares, insurance, severance pay and pensions, and separately mark the assets that need to be checked.
- 3
Preservation measures
For assets at risk of disposal, we first apply for provisional attachment or an injunction.
- 4
Mediation and ruling
We refine the claim to reflect the results of the asset inquiry, and if mediation fails, argue the division ratio and method in the court's ruling proceedings.

Frequently asked questions
It's been 1 year and 11 months since my divorce. Is it too late?
It only needs to be filed before the 2 years pass. If little time remains, we file the mediation application or petition first, even if not all the material has been gathered, and then supplement it with asset inquiries.
I found out about hidden assets after 2 years.
The right to claim property division expires after 2 years, so in principle you cannot claim again. If the other spouse actively deceived you, we can examine whether another civil claim is possible, but that is not an easy path, so it is important to act within the period.
Do I also have to claim compensation for emotional distress within 2 years?
Compensation for emotional distress (위자료) is a damages claim, so a different period from the 2 years for property division applies. However, the starting point can differ depending on the circumstances, so it is a good idea to review it together with property division.
