Affairs Between Two Married People (Cross Lawsuits)

If both people in the affair are married, while you claim against the affair partner, that person's spouse can also claim against your spouse. When the two lawsuits interlock, you must calculate what money is actually left for each household, and confidentiality too.

You may need a consultation if

  • The woman your husband had an affair with was also married
  • The wife of the man your wife had an affair with has sent your wife a complaint
  • You are married too, the other person's spouse has sued you, and your own spouse doesn't know yet
  • Both couples have decided not to divorce
  • The other side has proposed, "Let's not sue each other"

Relevant provisions

Civil Act (민법) Article 760 (Liability of joint tortfeasors)

The two people who committed infidelity are jointly liable as joint tortfeasors to each wronged spouse, and that liability is an "untrue" joint and several obligation (부진정연대채무) (Supreme Court Decision 2013므2441, rendered May 29, 2015).

Civil Procedure Act (민사소송법) Article 184 (Reporting a place for service)

A party or their legal representative may designate a place other than their address as the place to receive service and report it to the court.

Statutes are summarized. The official Korean text is available at the Korea Law Information Center (law.go.kr).

The two lawsuits proceed separately

If A's husband and B's wife had an affair, A can claim against B's wife and B can claim against A's husband. These are separate cases with different plaintiffs and defendants, so the judgments also come out separately.

Even for the same infidelity (부정행위), you cannot assume the two judgments will award the same amount. They can differ depending on each household's length of marriage, children, whether there is a divorce, and who was more active.

Calculate what is left per household

If both couples stay married, the compensation (위자료) you receive from the affair partner and the compensation your spouse pays to the other spouse move in and out of the same household budget. Once litigation costs are added, sometimes almost nothing is left.

So the two couples sometimes settle by agreeing not to claim against each other and only promising that the two will not meet and that everything stays confidential. Such an agreement should be signed by all four people involved to avoid later disputes.

If your spouse doesn't know yet

A married person who becomes a defendant in an affair lawsuit first worries about documents arriving at home. Appointing a legal representative or reporting a place for service lets you change where later documents are received.

However, focusing only on hiding it delays your response. Decide the order of steps keeping in mind that your own spouse also has a right to claim against the other affair partner.

Reimbursement gets tangled in too

An affair partner who paid compensation under a judgment can claim reimbursement (구상) from the person they had the affair with, up to that person's share. In an affair between two married people, this reimbursement also ultimately comes out of the other household's budget.

When ending the matter by settlement, include both a clause that neither side will exercise the right to reimbursement and a no-further-claims clause so you don't end up disputing again later.

Frequently asked questions

Do the lawsuit the other man's wife filed against my wife and the lawsuit I filed against that man cancel each other out?

The two lawsuits have different plaintiffs and defendants, so the court does not cancel them out on its own. Each gets its own judgment and each must be paid separately. To withdraw both or trade payments, a separate agreement is needed.

If both couples decided not to divorce, is there any point in suing?

You can sue, but if the marriage continues, compensation may be set lower and a counter-suit may come from the other household. If your goal is ending the relationship and preventing it from happening again rather than money, a settlement agreement may be the better choice.

I'm married too, and I'm worried the complaint will come to my home.

The first complaint is often served at your registered address, but for later documents you can change where they are received by appointing a legal representative or reporting a place for service. If you are still at the certified-letter stage before receiving a complaint, you can also designate your representative as the contact for replies.
