Reducing Compensation & Reimbursement Claims

Even if you admit the infidelity, you can still contest the amount of compensation. After paying the compensation, you also need to look at whether you can seek reimbursement of their share from the other person's spouse, who should bear liability with you.

You may need a consultation if

  • You did see the person, but the amount claimed is far too high
  • The relationship was short and you have already ended it
  • You paid all of the compensation yourself, while the other person's spouse bore no responsibility at all
  • You sued without divorcing and worry the affair partner will claim reimbursement from your husband
  • You think the first-instance award is excessive and are considering an appeal

Relevant provisions

Civil Act (민법) Article 760(1) (Liability of joint tortfeasors)

People who cause damage through a joint unlawful act are jointly and severally liable to the victim. Among those jointly liable, each person's share is determined, and this leads to the question of the right to reimbursement (구상권).

Civil Act Article 751 (Compensation for non-property damage)

Compensation for emotional distress (위자료) is also recoverable. The court sets the amount by considering all the circumstances that appear in the proceedings.

Civil Procedure Act (민사소송법) Article 396 (Period for appeal)

An appeal must be filed within 2 weeks of the day the written judgment is served. This is a peremptory period and cannot be extended.

Statutes are summarized. The official Korean text is available at the Korea Law Information Center (law.go.kr).

When reimbursement becomes an issue

  • The plaintiff divorces and sues both the spouse and the affair partner

    Reimbursement issue
The judgment often sets the joint liability of both
    Points to review
Check the operative part of the judgment and sort out the actual scope of payment
  • The plaintiff stays married and sues only the affair partner

    Reimbursement issue
After paying, the affair partner can claim their share from the plaintiff's spouse
    Points to review
For the plaintiff, consider adding a waiver of reimbursement in mediation or settlement
  • The affair partner pays all of the compensation

    Reimbursement issue
The issue is whether the amount paid beyond their own share can be recovered from the spouse
    Points to review
Payment records, the judgment or mediation terms, evidence that the spouse led the relationship
  • The settlement agreement includes a waiver of reimbursement

    Reimbursement issue
As a rule, it is hard to claim again
    Points to review
Before signing, confirm in writing the scope of what is being waived

The reimbursement ratio is not set by law; it is decided case by case by weighing the degree of responsibility of the two.

A reduction means arguing the amount is excessive

If you knew they were married when you met, it is hard to avoid liability itself. In that case, the approach is to show with evidence that the amount the plaintiff claims is too large for the circumstances of the case. The court looks at the length of the relationship, how often you met and how deep the relationship was, the effect on the marriage, and your attitude afterward.

If the relationship was short and you cut off contact right after it came out, records showing that date are the most important. The fact that the plaintiff couple had long-standing conflict before the affair may also be considered, but using it to blame the plaintiff backfires, so it should be handled only with objective evidence.

  • The length of the relationship and how many times you actually met
  • The date you ended the relationship and the fact there has been no contact since
  • Objective evidence of the plaintiff couple's conflict before the affair
  • A written apology delivered to the plaintiff
  • A promise not to make contact again

The plaintiff's own conduct can lower the amount

If the plaintiff took private revenge, such as causing a scene at the affair partner's workplace or posting the facts on social media, the suffering this caused the defendant may be considered when setting compensation. If the plaintiff is separately accused of defamation (명예훼손) or threats (협박), the case becomes more complicated.

Plaintiffs should also be careful about saying themselves that their marriage ended long ago. The affair partner will use those words to argue that the marriage had already broken down. Records of the plaintiff sending the affair partner sympathetic messages, such as "You must have been deceived too," are sometimes used against the plaintiff when the amount is set.

The spouse and the affair partner share liability

Infidelity (부정행위) is a tort committed jointly by the spouse and the affair partner. The two are jointly and severally liable to the plaintiff, and between themselves each has a share. If one pays more than their own share, they can claim the excess from the other; this is called the right to reimbursement.

If the affair partner paid all of the compensation, we look at whether they can claim reimbursement from the plaintiff's spouse. However, if the court views the compensation it awarded as falling within the affair partner's own share from the start, reimbursement may not be accepted. The terms of the judgment or mediation and how much the spouse led the relationship must be looked at together.

Why reimbursement matters for a plaintiff who stays married

If you sue only the affair partner without divorcing, and the affair partner then claims reimbursement from your spouse after paying, that money ultimately comes out of your own household. In effect, you hand back part of the compensation you received.

A judgment only decides whether to award compensation and how much; it does not settle the reimbursement issue. So a plaintiff who stays married should consider including, when ending the case through mediation or settlement, a clause that the affair partner will not claim reimbursement or any other money from the spouse. Getting this clause sometimes requires a concession on the amount, so the amount and the clause are decided together.

Contesting the amount on appeal

If you think the first-instance award is excessive, you must appeal within 2 weeks of being served with the written judgment. On appeal, we go through the reasons in the judgment one by one to see what circumstances the first instance relied on to set the amount, and fill in missing circumstances or wrongly found facts with new evidence.

If the first instance proceeded by service by publication (공시송달) and you didn't even know a judgment had been entered, we look at whether you can file a late appeal (추후보완 항소) within 2 weeks of the day you learned of it (Civil Procedure Act Article 173). The period is short here as well, so you need to move quickly.

Circumstances that decide whether the amount is reduced

Factors that work against you

  • · A long relationship with repeated cohabitation or travel
  • · Continuing the relationship after it came out
  • · Records of mocking the plaintiff or demanding that the family be broken up
  • · Contacting the plaintiff directly during the lawsuit

Factors that work in your favor

  • · A short relationship that has already ended
  • · Evidence that the other person's spouse led the relationship
  • · Objective evidence of deep conflict in the plaintiff's marriage before the affair
  • · Harm suffered from the plaintiff's public exposure or workplace visits
  • · A written apology and a promise not to make contact again

How Jisan Law's Family Law Center reviews your case

  1. 1

Analyzing the basis of the claim

A managing partner finds in the complaint the basis on which the plaintiff set the amount and checks, point by point, whether it matches the facts.

  2. 2

    Organizing grounds for reduction

We gather evidence that affects the amount, such as the length of the relationship, when it ended and the plaintiff couple's circumstances, and organize it in a table.

  3. 3

    Mediation negotiations

If mediation is better than a judgment for the case, we negotiate the amount, payment method, confidentiality and a no-further-claims clause together.

  4. 4

    Assessing reimbursement

After the compensation is paid, we look at the terms of the judgment or mediation and the spouse's degree of involvement, and judge whether a reimbursement claim is worthwhile.

Frequently asked questions

How much can I get back through reimbursement?

There is no ratio set by law. The court determines each person's share by weighing what role the spouse and the affair partner each played in the relationship and who was more active. If the court views the compensation the affair partner paid as their own share from the start, reimbursement may not be recognized.

I wrote in the settlement agreement that I waive reimbursement. Can I still claim it later?

As a rule, a right you waived yourself is hard to exercise again. However, if the scope of the waiver is unclear from the wording, or another term that formed the basis of the agreement was not honored, there may be room to argue. It has to be judged by looking at the whole agreement.

If the plaintiff also had an affair, will the amount be reduced?

The fact that the plaintiff also bears responsibility for the breakdown of the marriage can be considered when setting the amount. The Supreme Court has held that when the responsibility of both spouses is equal and the compensation claim against the spouse is dismissed, a third party who took part in the infidelity cannot be held liable for damages on the ground of the divorce either (Supreme Court Decision 2023므16678, rendered June 27, 2024). That ruling concerns a case that ended in divorce, so the structure of your case must be checked first.

Doesn't writing an apology mean admitting fault?

In a case where you contest the infidelity itself, be careful with an apology letter. On the other hand, in a case where you admit liability and contest the amount, a sincere apology can be considered as a ground for reduction. We first decide on the direction of your response, then review the wording together.

Can I pay the compensation in installments?

A judgment usually orders payment in a lump sum, so if you want installments, they must be agreed through mediation or settlement. Installment terms often include a clause that if even one payment is late, the remaining balance becomes due at once, so make sure the schedule is one you can manage.
