Relevant laws
Road Traffic Act (도로교통법) Article 43 and Article 152, Item 1
Driving a car without a license or while your license is suspended is punishable by up to 1 year in prison or a fine of up to KRW 3 million. The same applies if you have no International Driving Permit or similar, if it has expired, or if you are banned from driving.
Road Traffic Act Article 154, Item 2 and Article 156, Item 13
Riding a motorized bicycle (motorbike) without a license is punishable by a fine of up to KRW 300,000 or short-term detention. Riding a personal mobility device such as an e-scooter without a license is punishable by a fine of up to KRW 200,000, short-term detention or a petty fine.
Road Traffic Act Article 82(2) (Disqualification Period)
If you drive without a license, you cannot get a license for 1 year from the date of the violation (6 months for a motorized bicycle license), or 2 years if it is your third time or more. If you injure someone while driving without a license and do not take the required measures or report it, the period is 5 years. If you receive a sentence lighter than a fine, a suspended sentencing (선고유예) or a suspension of indictment (기소유예), you can get a license even within this period.
Statutes are summarized. The official Korean text is available at the Korea Law Information Center (law.go.kr).
We first check whether you knew about the suspension or revocation
Unlicensed driving is an intentional crime, so you are only punished if you drove knowing your license was suspended or revoked. We check whether you received the notice of the decision, whether the notice was replaced by public notice because of a change of address or similar reason, and how you understood the last day of your suspension.
Driving on the last day of a suspension still counts as driving during the suspension. Miscalculating the period may be taken into account, but on its own it is unlikely to lead to an acquittal.
If you drove somewhere other than a road, this can be disputed
The Road Traffic Act applies only some provisions, such as drunk driving, drugged driving and measures after an accident, to driving in places other than roads, and the unlicensed driving provision is not on that list (Article 2, Item 26). So if you were stopped inside an apartment complex or a building parking lot, the issue is whether that place was open for the general public to pass through.
Use photos and the building's management rules to show whether outside vehicles are controlled with a barrier and security staff, or whether anyone can come and go.
An unlicensed accident is punishable even with insurance
An accident that injures someone while driving without a license is an exception under the Act on Special Cases Concerning the Settlement of Traffic Accidents (교통사고처리 특례법), so you can be prosecuted even if you have comprehensive insurance or the victim does not want you punished (Article 3(2), proviso, Item 7). A settlement with the victim often decides the outcome.
An employer who has an employee drive while knowing the employee has no license is also punished (Article 152, Item 2). Repeating the same violation is treated harshly at sentencing, and if you are on a suspended sentence (집행유예), the risk of actual imprisonment rises.

Frequently asked questions
I only moved my car inside my apartment parking lot.
Unlicensed driving is only punished when it happens on a road. The answer can depend on whether outsiders and outside vehicles can freely enter that parking lot or whether access is controlled.
Can I get a new license right after I pay the fine?
Even after a fine becomes final, the disqualification period of 1 year from the date of the violation (6 months for a motorized bicycle license) must pass. If you receive a suspension of indictment or a suspended sentencing, you can get a license even within that period.
Is riding an e-scooter without a license also unlicensed driving?
To ride a personal mobility device, you need at least a motorized bicycle license. Riding without one is punishable by a fine of up to KRW 200,000, short-term detention or a petty fine.
