False Accusation

False accusation (무고) is committed when someone reports false facts to investigators or other authorities to get another person punished. It is a serious crime with a statutory penalty of up to 10 years in prison. Whether you are filing a counter-complaint or have been accused of false accusation, the key is how falsity and intent are proven.

When you may need advice

  • I was accused of sexual harassment and the police decided not to refer the case, and now I want to sue the accuser for false accusation
  • I filed a fraud complaint because I was not paid back, and the other person filed a counter-complaint for false accusation
  • I exaggerated in a report out of anger, and it is weighing on me
  • Someone made a false report about me to my company and got me disciplined

Relevant laws

Criminal Act (형법) Article 156 (False Accusation)

Reporting false facts to a public office or public official with the aim of having another person receive criminal or disciplinary punishment is punishable by up to 10 years in prison or a fine of up to KRW 15 million.

Criminal Act Article 157 (Confession, Voluntary Surrender)

If a person who made a false accusation confesses or surrenders before the judgment or disciplinary decision in the reported case becomes final, the penalty is reduced or waived (applying Article 153).

Statutes are summarized. The official Korean text is available at the Korea Law Information Center (law.go.kr).

Being cleared does not mean the accusation was false

The fact that the accused person received a decision of no charge (혐의없음) does not by itself make the complainant guilty of false accusation. The Supreme Court has held that the mere failure to prove the reported facts true does not immediately establish that they were false (Supreme Court Decision 2007도6406, October 11, 2007).

For false accusation to be found, it must be shown that the reported facts differ from the objective facts, and that the person who reported them knew this or at least recognized they might be false. The starting point is to find, in the original case record, where the complainant's account changed and where it conflicts with objective evidence.

Partial exaggeration differs from a false report

Court decisions tend to hold that if the core of the report is true and only some parts were exaggerated or the legal assessment was wrong, it is hard to call it false accusation. A typical example is a fraud complaint over money not returned that ends up treated as a civil matter.

On the other hand, inventing something that never happened, or fabricating facts that decide whether a crime was committed, can be false accusation. Beyond reports to the police or the prosecution service (공소청), when a report is made to a supervisory body or a company to get someone disciplined at work, we also examine whether it counts as a report to a public office or public official.

Decide on a counter-complaint after seeing the outcome of the original case

Filing a counter-complaint while the original case is still ongoing can look like an attempt to pressure a settlement, and the decision may be put off because the original case has not concluded. So many people file after a non-referral (불송치), non-indictment (불기소) or acquittal becomes final, using that record as the basis.

If you have been accused of false accusation, you need to show with evidence that you had grounds to believe what you reported at the time. If you did in fact make a false report, confessing or surrendering before the original case becomes final can reduce or waive the penalty.

Factors that affect the outcome and sentence

Factors that work against you

  • · Falsely reporting a serious crime such as a sex crime
  • · Fabricating false evidence
  • · Serious harm, such as the other person being detained or investigated for a long time
  • · Evidence of an aim to extract settlement money

Factors that work in your favor

  • · There were circumstances that gave reason to believe it at the time of the report
  • · The core facts were true, with only some exaggeration
  • · Confessing or withdrawing the complaint before the original case became final
  • · Apologizing to the other person and making up for the harm

Frequently asked questions

The decision clearing me says "insufficient evidence." Can I file a complaint for false accusation?

Insufficient evidence means the allegation was not proven, not that it was false, so this alone is unlikely to establish false accusation. First check whether there is other evidence that the complainant knew it was false.

If the accuser is convicted of false accusation, what happens to my original case?

A person who was convicted because of a false accusation can request a retrial once the false accusation is proven by a final judgment (Criminal Procedure Act Article 420, Item 3).

If I withdraw my complaint, does my liability for false accusation disappear?

Even if you withdraw the complaint, the fact that you made a false report remains, so the crime of false accusation does not go away. However, confessing or surrendering before the trial or disciplinary decision in the original case becomes final reduces or waives the penalty.
