Insult (Group Chats, Games, Comments)

Many people in Korea face criminal complaints for swearing in group chats, in-game chat or online comments. Insult (모욕죄) requires publicity and identifiability, and because it can only be prosecuted upon complaint (친고죄), the case ends if the complaint is withdrawn.

When you may need advice

  • I swore during an argument in a group chat and was asked to appear for questioning for insult
  • I swore at someone in an in-game chat, and they gave their name and number and said they would file a complaint
  • I was told I had been sued over a comment on a news article
  • The other person is demanding several million won as settlement money
  • I keep being sworn at online and want to file a complaint

Relevant laws

Criminal Act (형법) Article 311 (Insult)

Publicly insulting a person is punishable by up to 1 year in prison or imprisonment without labor, or a fine of up to KRW 2 million.

Criminal Act Article 312(1) (Complaint and the Victim's Wishes)

Insult is a crime that can only be prosecuted if a complaint is filed.

Criminal Procedure Act (형사소송법) Article 230(1) (Complaint Period)

For crimes prosecuted only upon complaint, a complaint cannot be filed once 6 months have passed from the day the victim learned who the offender was.

Statutes are summarized. The official Korean text is available at the Korea Law Information Center (law.go.kr).

In group chats, publicity depends on the number of members and their relationships

Like defamation, insult is only established when it is done where an unspecified or large number of people can learn of it. Group chats with several members are often found to meet this publicity requirement.

By contrast, swearing in a one-on-one chat with only the other person lacks publicity, so it is unlikely to be insult. For a small room of about three people, you need to consider the members' relationships and how likely the conversation was to spread outside.

Where only nicknames are visible, identifiability can be disputed

If you swore at someone in a game or anonymous community based only on their username, it may be found that the victim was not identified if the people around them could not tell who that username belongs to in real life.

Recently there have also been reported cases where someone deliberately provokes swearing, then types their name and phone number in the chat and demands settlement money under threat of a complaint. Typing personal details in the chat does not automatically establish identifiability, so capture the entire chat flow.

Swearing is different from rude criticism

An insult is an expression of contempt for a person without stating facts. There have been decisions holding that somewhat harsh or rude words were not an insult if they were not enough to lower the other person's social reputation.

The context matters as much as the words used. You need to show whether the other person provoked you first, whether it was a one-time remark, and what else was said in the same chat.

If the complaint is withdrawn, the case ends

Because insult is a crime prosecuted only upon complaint, there can be no punishment if the complainant withdraws the complaint before the first-instance judgment is pronounced. A person who withdraws cannot file another complaint about the same case (Criminal Procedure Act Article 232).

There is no set standard for settlement amounts. The safer order is to first check whether the charge can be established, and to negotiate the amount only when it is likely to be. Be sure the settlement agreement includes a clause that the complaint will be withdrawn.

Factors that affect the outcome and sentence

Factors that work against you

  • · Repeating it several times, or several people swearing together
  • · Expressions targeting family, appearance or disability
  • · Continuing with a different account after the victim blocked you
  • · A similar prior conviction

Factors that work in your favor

  • · The other person provoked you or swore first
  • · A one-time remark followed by an immediate apology
  • · It was a space where only nicknames were visible
  • · Withdrawal of the complaint or a settlement

How our Criminal Law Center handles your case

  1. 1

Check whether the crime is established

Looking at the number of chat members, how far nicknames were linked to real identities and when the complaint was filed, we check for issues of publicity, identifiability and the complaint deadline.

  2. 2

    Secure the whole conversation

We guide you to back up the entire conversation before and after, not just the one line at issue.

  3. 3

    Attend questioning

Before questioning, we rehearse the expected questions, then attend with you and raise objections to leading questions.

  4. 4

    Written opinion or settlement

If the case should be contested, we argue in a written opinion that there is no crime. If you admit it, we decide together when and how to settle, and Jisan Law handles settlement contact with the other party on your behalf.

Frequently asked questions

I swore in a game, and the other player gave me their name and number.

Typing a name and number in the chat does not automatically establish identifiability. The question is whether other users there could recognize that username as that real person. Before sending money out of fear, first check whether the crime is actually established.

Is online insult punished more heavily?

The Information and Communications Network Act has penalty provisions for defamation, but none that punish insult more heavily. Swearing online is also punished under Criminal Act Article 311, with the same statutory penalty.

Does a record remain if the complaint is withdrawn?

If the complaint is withdrawn, the case ends with a decision not to refer it to prosecutors (불송치) for lack of a right to prosecute at the police stage, or with dismissal of the prosecution (공소기각) after indictment, so no criminal record remains. However, a record that you were investigated stays in the investigative agencies' internal files.
