Frequently asked questions

What are the Sentencing Guidelines, and do judges have to follow them?
The Sentencing Guidelines are recommendations set by the Sentencing Commission that judges refer to when deciding a sentence. This calculator shows the recommended range under the 2026 Sentencing Guidelines (Sentencing Commission), and the actual sentence may differ.
How is the mitigated, basic or aggravated range decided?
The special sentencing factors are compared: if the aggravating factors weigh more, the aggravated range is recommended; if the mitigating factors weigh more, the mitigated range; otherwise, the basic range. When the numbers are equal, conduct factors (about the crime itself) weigh more than offender & other factors (about the defendant's circumstances and the like), and the victim not wanting punishment may be given the same weight as a conduct factor.
Can I get a suspended sentence?
A suspended sentence can only be given with a prison sentence of 3 years or less. The guidelines recommend a suspended sentence if there are at least 2 more major positive factors than major negative factors, and an actual prison term if there are at least 2 more major negative factors. Otherwise, or if the difference in general factors on the other side is larger, the judge compares all the factors and decides.
Are there cases where the Sentencing Guidelines do not apply?
They do not apply where a fine is chosen (except for election, traffic, stalking and animal protection crimes), to attempts (except attempted murder), to aiding and abetting, to defendants under 19, or where the crime is tried together with a crime already finally judged. If several crimes are tried together, the range changes under the rules for multiple crimes, but this calculator looks at one crime only.

This is a reference calculation based on the 2026 Sentencing Guidelines (Sentencing Commission). The guidelines are recommendations that judges refer to, and the actual sentence may differ. Which factors are recognized depends on the evidence and the circumstances of the case, so if you are facing trial, talk to a lawyer first.
