Frequently asked questions

What is a requested sentence, and is it the sentence I will actually receive?
The requested sentence (구형) is the penalty the prosecutor asks the court to impose at trial. The final sentence is decided by the court, so the request and the actual sentence can differ.
What is the difference between a suspension of indictment, a summary fine and a formal trial?
A suspension of indictment (기소유예) means the wrongdoing is recognized, but the prosecutor takes various circumstances into account and closes the case without sending it to trial. A summary indictment (약식기소) sets a fine on the documents without a trial in a courtroom, while in a formal trial (구공판) the prosecutor asks the court for a trial and you stand before a judge in a courtroom.
Will settling with the victim make the punishment lighter?
A settlement is one of the main circumstances considered in deciding how a case is handled, along with prior convictions, the extent of the harm and how the crime happened, which is why the calculator asks about it for many crimes. How much a settlement affects the result depends on the crime and the other circumstances.
How reliable is the estimated result?
It is only an estimate based on how investigative agencies usually handle cases; the actual decision and request depend on the facts of the case and the judgment of the prosecutor in charge. This version covers only crimes that often come up in cases involving foreign nationals, so for other crimes, please send us a message. If you are about to be questioned, do not rely on the result alone and talk to a lawyer first.
