Relevant laws
Labor Standards Act Articles 36, 43 and 107 (Settlement of Payments; Payment of Wages; Penalties)
When a worker leaves, wages and other payments must be made within 14 days, and wages must be paid directly, in full and in currency, at least once a month on a fixed date. From October 8, 2026, violations are punishable by imprisonment of up to 5 years or a fine of up to KRW 50 million, and cannot be prosecuted if the victim expressly does not want punishment (except for employers whose names have been publicly disclosed as delinquent).
Employee Retirement Benefit Security Act Articles 4, 8, 9 and 43
A worker who has worked continuously for 1 year or more, averaging 15 hours or more per week over 4 weeks, must be paid severance pay of at least 30 days' average wages for each year of service, within 14 days of leaving. Failure to pay is punishable by imprisonment of up to 5 years or a fine of up to KRW 50 million.
Act on the Employment of Foreign Workers Article 13 (Departure Guarantee Insurance and Trusts)
Employers who hire foreign workers must enroll in Departure Guarantee Insurance (출국만기보험) or a similar plan to pay severance, and the insurance money is paid within 14 days of departure (or within 14 days of the application date if applied for due to a change of status of stay or after departure). The right to claim expires if not exercised for 3 years.
Industrial Accident Compensation Insurance Act Articles 6 and 112
It applies to all businesses that employ workers (except some businesses specified by Presidential Decree), and the right to receive insurance benefits expires if not exercised for 3 years (5 years for disability and survivors' benefits, funeral expenses, etc.).
Statutes are summarized. The official Korean text is available at the Korea Law Information Center (law.go.kr).
You can claim wages even without a valid status of stay
The Supreme Court held that an employment contract made by a foreigner without work authorization is not automatically void, and that the worker can receive payment for work already done and industrial accident insurance benefits (Supreme Court Decision 94Nu12067, September 15, 1995). An employer refusing to pay wages because the worker has no status of stay is not justified.
If you file a petition with the Labor Office, a labor inspector investigates the facts. A labor inspector's investigation of unpaid wages is one of the duties in which the duty to notify immigration can be waived when helping the victim comes first (Enforcement Rules of the Immigration Act Article 70-2(5)). However, this requires the judgment of the official in charge, so get advice before filing a petition.
Departure Guarantee Insurance and severance pay may not be the same amount
Severance pay for workers under the Employment Permit System is mainly paid through Departure Guarantee Insurance, to which the employer contributes monthly. Enrolling in this insurance is treated as setting up a severance pay system, but if the insurance payment is less than the severance pay calculated under the law, you need to consider whether you can claim the difference from the employer. Differences often arise when there was a lot of overtime or wages increased.
In principle, Departure Guarantee Insurance is paid within 14 days after departure, and the claim expires if not made within 3 years. Check the amount you will receive before leaving, and leave accurate bank account information.
Steps to get the money owed to you
First, we calculate the amount owed using your employment contract, pay slips, attendance records and salary transfer records. Next, we file a petition with the regional employment and labor office to have the unpaid wages confirmed, and if the employer still does not pay, we create an enforceable basis through a civil lawsuit or a payment order (지급명령). If there is a risk that the company's assets will be moved, we first apply for a provisional attachment.
If the company has gone bankrupt or is found unable to pay, or if you have obtained a judgment ordering payment of unpaid wages, you can use the substitute payment system (대지급금), under which the state pays a certain range of wages on the employer's behalf (Wage Claim Guarantee Act Article 7).
From October 8, 2026, the penalty for employers who fail to pay wages and retirement payments became heavier: imprisonment of up to 5 years or a fine of up to KRW 50 million. For unpaid wages that arose before then, the provisions before the amendment may apply.
If you were injured at work, start with an industrial accident claim
Industrial accident insurance applies to businesses that employ workers, regardless of the worker's status of stay. Even if the company blocks an industrial accident claim or suggests handling it privately as a company-paid injury (공상), the worker can apply directly to the Korea Workers' Compensation and Welfare Service (근로복지공단) for medical care benefits. Keep the contact details of coworkers who know what happened on the day of the injury, hospital records and photos.
During treatment, your departure schedule is the biggest worry. Being under treatment for a work-related injury is sometimes taken into account in extending your stay or calculating the workplace change period, so get advice together with your expiry date in mind.

Frequently asked questions
Can I get my unpaid wages even after I leave Korea?
If you appoint a representative, the lawsuit and enforcement can continue after you leave. However, it is much easier if you file the petition, have the unpaid wages confirmed and organize your bank account before leaving.
My boss wants me to sign a settlement saying I do not want him punished.
Unpaid wages is a crime that cannot be prosecuted if the victim does not want punishment. If you sign a statement that you do not want punishment (처벌불원서) before you have actually received all the money, you may lose your leverage, so sign it after payment is complete or clearly state the terms of installment payments.
Do I get no severance pay if I worked less than 1 year?
Severance pay arises when you have worked continuously for 1 year or more, averaging 15 hours or more per week over 4 weeks. If your contract was cut short and renewed repeatedly, we need to examine whether you actually worked continuously.
The company has closed and I cannot reach the owner.
If the company has gone bankrupt or is found unable to pay, or if you obtain a judgment or payment order for unpaid wages, you can apply for the substitute payment, under which the state pays a certain range of wages on the employer's behalf (Wage Claim Guarantee Act Article 7). First, file a petition with the Labor Office to have the unpaid wages confirmed.
