Criminal Complaints by Foreign Victims

Foreigners who are victims of crime can file a criminal complaint regardless of their nationality or visa status. If you are hesitating to report because of concerns about your stay, first check the rule under which public officials may be exempt from their duty to notify immigration when helping the victim comes first.

When you should get advice

  • I was hit at work, but I cannot report it because my period of stay has expired
  • I sent money for a secondhand item, but it never arrived and the seller stopped responding
  • I was sexually harassed by a manager at my company
  • Someone from my own country cheated me out of money I lent them
  • It is hard for me to write a criminal complaint in Korean
  • The offender's side keeps contacting me to settle

Relevant laws

Criminal Procedure Act Articles 223 and 237 (Persons Entitled to File a Complaint; Form of Complaint)

A person harmed by a crime can file a criminal complaint, either in writing or orally, with a judicial police officer.

Immigration Act Article 84(1) proviso; Enforcement Decree Article 92-2; Enforcement Rules Article 70-2 (Exemption from the Duty to Notify)

Public officials who discover a person violating the Immigration Act must notify the immigration office. However, they may choose not to notify if they find that helping the victim must come first in duties such as investigating crimes like murder, bodily injury, assault, unlawful arrest or confinement, intimidation, sexual crimes, theft, robbery or fraud, or a labor inspector's investigation of unpaid wages.

Immigration Act Article 25-2 (Special Rules for Marriage Migrants, etc.)

A foreigner who has a trial, investigation or other legal remedy in progress because they were a victim of domestic violence, sexual violence, child abuse or human trafficking can be permitted to extend their period of stay until the procedure ends.

Act on Special Cases Concerning Expedition of Legal Proceedings Article 25 (Compensation Orders)

When a court convicts a defendant of certain crimes, such as bodily injury, sexual crimes, theft, fraud or embezzlement, it can, on the victim's application or on its own initiative, order compensation for direct property damage, medical expenses and emotional distress.

Statutes are summarized. The official Korean text is available at the Korea Law Information Center (law.go.kr).

You can file a complaint even if your visa status is uncertain

The right to file a criminal complaint does not depend on nationality or status of stay. Still, foreigners whose period of stay has expired hesitate to report because they fear being handed over to the immigration office if they go to the police station. The Immigration Act requires public officials to report violators they discover, but it makes an exception allowing them not to notify when helping the victim must come first, such as in a criminal investigation.

This exception applies to investigations of crimes such as assault, bodily injury, intimidation, confinement, sexual crimes, theft, robbery and fraud, and to a labor inspector's investigation of unpaid wages, among others. However, the official in charge decides whether to notify, so the outcome cannot be guaranteed. Get advice before reporting and decide on the order and method.

Preparing the complaint and your statement

A complaint can be made orally, but if the case is complicated or your Korean is limited, it is more accurate to write the complaint in advance. Write down when, where, who and what happened in chronological order, and attach a list of evidence. You can also submit a written statement in a foreign language.

You can also ask for an interpreter when you are questioned as a victim. If you feel very anxious or tense about the questioning, you can ask for a person you trust to be present with you (Criminal Procedure Act Article 221(3) and Article 163-2). After giving your statement, listen to the record again through the interpreter before signing.

Stay for victims of domestic or sexual violence

If an investigation or trial is in progress because you were a victim of domestic violence, sexual violence or human trafficking, there is a special rule that allows you to receive extensions of stay until the procedure ends. If needed for recovery from the harm, the stay can be extended even after that.

To use this special rule, you need documents showing that the case is actually in progress. Keep your complaint receipt, case number and court documents safe.

How to recover your losses

If the offender is indicted, in some cases you can apply for a compensation order in the criminal trial and receive damages without a separate civil lawsuit. If you lost money, as in fraud cases, we also consider a provisional attachment (가압류) to freeze the offender's assets in advance.

If a crime victim dies or suffers a disability or serious injury and cannot receive compensation, there is a system under which the state pays crime victim relief money. Foreigners can receive it if they are nationals of a country with a reciprocal guarantee, or if they are, for example, the spouse of a Korean national and hold a specified status of stay such as permanent residency (Crime Victim Protection Act Article 23).

You can file a complaint even if Korean is difficult for you

When a foreigner who is not fluent in Korean wants to file a complaint orally, the police must hear the statement through an interpreter and prepare a complainant statement record (Rules on Criminal Investigation Article 217(2)). If needed, you can also submit a written statement in a foreign language.

However, going through an interpreter takes a long time, and details are easily left out. Write down on paper in advance the details that must be accurate, such as dates, amounts and the other person's name, and bring it with you.

Frequently asked questions

If I file a complaint, will I be handed over to the immigration office too?

If it is found that helping the victim comes first during a criminal investigation, the duty to notify can be waived. However, this depends on the official's judgment, so we cannot say it will definitely be waived. Organize your situation before reporting, and consider going with a representative.

Can I continue the case after I return to my home country?

If you appoint a lawyer as your representative, you can continue the criminal complaint and civil lawsuit even after leaving Korea. However, your statement as the victim may be needed again, so it is a good idea to give as much of your statement and evidence as possible before leaving.

If the offender offers me settlement money, can I accept it?

You can, but if the settlement agreement includes a statement that you do not want the offender punished (처벌불원), cases where the victim's wishes matter, such as assault, may end there. Check the amount, the payment method and the wording before signing.
